Village of Republican City

 

The regular monthly meeting of the Board of Trustees was held on February 4, 2015, at 7:00 p.m. at the Fire Station with Trustees Crawford, Eddy, Einspahr, Hammond and Orcutt present.  Clerk Waldo, Utility Supervisor Whetstine, Shirley Valentine, Josie Kelly and Attorney Jaclyn Cannaday were also present. Posted notices in three public places within the village.  Notice of meeting and agenda was given to Trustees in advance. As required by law Chairman Eddy, pointed out the copy of the Opens Meeting Act posted on the wall for public viewing and called the meeting to order.  Proceedings shown were taken while convened meeting was open to the public.

Motion by Hammond, seconded by Crawford, to approve the minutes of the January 5, 2015 and January 13, 2015 meetings as published   Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion. Motion carried. 

Motion by Hammond, seconded by Orcutt to pay the following bills:

Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.

Treasurer’s report was read and approved.

CD rate comparison chart for local banks was reviewed by the Board. 

Job descriptions were reviewed and will be placed in personnel files.

Motion by Orcutt, seconded by Crawford to approve the new sewer lagoon lease with the US Army Corps of Engineers.  Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.

Josie Kelly was present to discuss the purchase of Southern Horizons Addition, Lot 3-5.  At this time, Kellys would like to purchase just SHA, Lot 5.  Due to lack of frontage, Attorney Cannaday recommended that lots 3-5 be resurveyed into two lots instead of three.  Discussion was held regarding if the total deposit of $2100.00 on the 3 lots could be applied to balance of purchase price if only one lot was purchased.  If only one lot is purchased, the deposit on the other two will be forfeited.  Motion by Hammond, seconded by Einspahr to table the topic while Miss Kelly discussed with Mr. Kelly.  Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.  Miss Kelly left the meeting. 

Ordinance 285 was read by title:  AN ORDINANCE TO REVISE ALL THE ORDINANCES OF THE VILLAGE OF REPUBLICAN CITY, NEBRASKA BY ADOPTING THE 2014 EDITION OF THE NEBRASKA BASIC CODE OF ORDINANCES, TO REPEAL PRIOR ORDINANCES; TO REQUIRE FILINGS; AND TO PROVIDE AND EFFECTIVE DATE.  Motion by Hammond, seconded by Crawford to suspend the rule requiring 3 separate readings of this Ordinance.  Voting Aye:  Crawford, Eddy, Hammond, Orcutt and Einspahr.  There were no votes against the motion.  Motion carried.  Motion by Hammond, seconded by Einspahr to approve Ordinance 285.  Voting Aye:  Crawford, Eddy, Hammond, Orcutt and Einspahr.  There were no votes against the motion.  Motion carried. 

Motion by Einspahr, seconded by Hammond to approve the building permit for 301 Truman.  Voting Aye:  Crawford, Eddy, Einspahr and Hammond.  There were no votes against the motion.  Abstain:  Orcutt.  Motion carried.

Motion by Orcutt, seconded by Einspahr to approve Diana Eddy as an alternate member of the Planning Commission.  Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.

Discussion was held regarding the moving of water meters at 2 Circle Drive and 6 Circle Drive from the meter pits to inside the building.  Due to plumbing in the building, water for 2 Circle Drive is going through both meters.  Clerk will continue to bill base rate for water and sewer for 2 Circle Drive.  Metered water for 2 Circle Drive and 6 Circle Drive will be on bill for 6 Circle Drive and the property owner and renter will determine how to handle between themselves.

Miss Kelly returned to the meeting.  Motion by Hammond, seconded by Crawford to take discussion of the sale of SHA, Lots 3-5 from the table.  Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.  After further discussion, it was determined that the village cannot sell one lot as bids were taken for the 3 lots together with one minimum bid required.  In order to purchase one or two of the lots, the purchase/request for bids process would have to start over and would not be finalized until May.  This requirement is based on State statutes.  Miss Kelly stated that she would like to buy Southern Horizon, Lots 6 and 7 instead.  Motion by Hammond, seconded by Einspahr to apply $1050.00 of previous deposit to the non-refundable deposit on SHA, Lot 6 with the balance going towards the remaining purchase price once sale was closed and to apply $1050.00 of previous deposit to the non-refundable deposit on SHA, Lot 7 with the balance going towards the remaining purchase price once sale was closed.  Voting Aye:  Crawford, Eddy, Einspahr, Hammond and Orcutt.  There were no votes against the motion.  Motion carried.  Separate resolutions will be presented at March 2015 meeting with separate Ordinances to close on each property at the April 2015 meeting.  SHA, Lots 3, 4 and 5 will be resurveyed into two lots.

Motion by Einspahr, seconded by Orcutt to adjourn at 8:04 p.m.

The next regular scheduled village board meeting will be held Monday, March 2, 2015 at 7:00 p.m. at the Fire Hall.  Meeting is open to the public and the public is encouraged to attend.
